This User Agreement (the "Agreement") governs your access to and use of the PracUP websites and mobile applications (the "Platform", the “Website”), including Website link and its associated mobile applications (the "PracUp Site"), The Platform is made available by PeopleNorth Ad Con. subject to the terms and conditions contained in this Agreement, to learners ("Coachees") and tutors ("Coaches") who offer coaching services through the Platform. The terms "User", "you", and “your" refer to anyone accessing or using the Platform, including Coachees, their parents or legal guardians if Coachees are under the age of eighteen (18), and Coaches.

Eligibility

You may use the Platform only if you can form a binding contract with PracUp, and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules, and regulations.

Coachees must be at least 18 years old to use the PracUp Site. Coachees under the age of 18 may use the PracUp Site, but only if their parent or legal guardian has provided PracUp verifiable consent and agreed to this Agreement. If you are a Coachee, you represent that your use of the Platform complies with these age restrictions.

If you are a Coach or prospective Coach, you represent that you are over the age of 18. PracUP may issue other Coach eligibility requirements from time to time, and the requirements may vary depending on the applicable Coaching Service. PracUP reserves the right to assess and reassess your eligibility at any time at its sole discretion and may request information from you at any time to make such determinations.

If PracUp has previously prohibited you from accessing or using the Platform, you are not permitted to access or use the Platform.

General Terms

• You should not unlawfully use this site; you must respect the Website Terms and Conditions and follow the Privacy Policy.
• Under no situations or circumstances, will the Company be liable for any change in the content which it provides on the Website through its products and services, including but not limited to any errors, omissions, loss, or damage experienced in connection with the use of any content made available via our products, services, or various resources such as email, blog posts, etc.
• Our Company Products are available to any user with access to the Internet. However, we are not responsible for the charges incurred for the usage of hardware, software, or internet services provider fees. Also, the user is fully responsible for the proper functioning of computer hardware and internet access.
• You will be required to use login credentials for some of the sections on the Website and the Company reserves the right to block access to our services for any user who does not follow these conditions.
• We undertake commercially reasonable efforts to ensure that users get uninterrupted access to our service, but cannot guarantee said access.

Additional Terms

Any personal information submitted in connection with Your use of the Products or the Website is subject to Our Privacy Policy, which is hereby incorporated by reference into these Terms.

Any product purchased online on PracUp Site or App is non-transferable and is intended for the sole use of the buyer only PracUp.

You acknowledge that all intellectual property rights in the Website and the underlying technology belong to us or our licensors and that you have no rights in, or to, the website other than the right to use it in accordance with the Terms.

Please note that the Online Classes videos are not downloadable. Sharing your access or trying to sell or distribute videos is a legally punishable offence. If caught doing this we will initiate legal proceedings and a penalty will be imposed on the user.

General User Guide

Do not insult, abuse, harass, stalk, threaten, or infringe the rights of others. Do not publish, post, distribute or disseminate any defamatory, infringing, indecent, offensive, or unlawful material or information.

Do not upload, install, or transfer files which are protected by Intellectual Property Laws or software which affects other computers.

Do not edit our HTML source code, reverse engineer, or attempt to hack our Company Products.

Do not run Spam services/scripts or anything which could affect the infrastructure, and in turn, the users.

Do not communicate spam, advertise, or sell services such as digital downloads, eBooks, or phishing links.

You may not copy, distribute, or plagiarise our website content or user-submitted content. Do not use any content which violates any legal, regulatory, Governmental or network operator conditions or codes of practice.
